Resumen
[ES] La problemática de la duración indeterminada de un procedimiento judicial y su posible alteración sobre los efectos que la sentencia producirá entra en conflicto con el principio constitucional de la tutela judicial efectiva que toda persona posee. Por tanto, hará necesaria la adopción de un instrumento procesal complementario que serán las medidas cautelares. Su finalidad primordial es la de asegurar la efectividad de la sentencia futura del proceso principal. Así, se trata de un instrumento de carácter provisional ya que depende de la duración de otro proceso. El proceso de solicitud se realizará a instancia de parte, siendo las partes procesales las encargadas de probar una serie de presupuestos necesarios para la estimación de las mismas. Finalmente, de acuerdo a las circunstancias y valoraciones de cada caso en concreto, las medidas cautelares serán estimadas o no por los órganos competentes para su adopción.
[EN] The problem of the undetermined duration of a judicial procedure and its possible alteration of the effects that the court ruling will produce is in conflict with the constitutional principle of effective judicial protection that every person possesses. It will therefore require the adoption of an additional procedural instrument in the form of precautionary measures. Their primary purpose is to ensure the effectiveness of the future sentence of the main proceedings. So, it is a provisional instrument since it depends on the duration of another process. The application process will be carried out at the request of a party, and the parties to the proceedings will be responsible for proving a series of assumptions necessary for their assessment. Finally, according to the circumstances and assessments of each specific case, the precautionary measures will be estimated or not by the competent bodies for their adoption.
