Resumen
[ES] El proceso de ejecución hipotecaria se encuentra configurado
como un proceso de ejecución especial debido a la propia
sustantividad de sus peculiaridades, circunstancia que recae de
fonna inmediata en la delimitación objetiva de esta vía procesal.
Teniendo en cuenta esta circunstancia las singularidades que hacen
especial este procedimiento se encuentran reconocidas de forma
explícita en la Ley de Enjuiciamiento Civil, al regular en el Tit. IV
de su Libro III, un capítulo, el V, denominado: "De las
particularidades de la ejecución sobre bienes hipotecados o
pignorados". La singularidad del mismo y las numerosas
modificaciones y reformas habidas en los últimos años justifican
su análisis de manera independiente a la ejecución civil ordinaria.
[EN] The process of mortgage execution is fonned as a process of special execution dueto the own substantive of his peculiarities, circumstance that relapses of immediate fonn into the objective delimiting of this procedural route. Bearing this circumstance in mind the singularities that make this procedure special are recognized of explicit fonn in the Law of Civil Prosecution, on having regulated in the Tit. The IVth of his Book 111, one chapter, the V, named : "Of the particularities ofthe execution on mortgaged or pawned goods ". The singularity of the same one and the numerous modifications and reforms which have been in the last years justify his analysis of an independent way to the civil ordinary execution.
