Las medidas cautelares desempeñan en la práctica un papel muy protagonista, debido a la importancia que desarrollan para garantizar el correcto funcionamiento del proceso, además de servir de cauce para responder a las numerosas demandas que tienen como fin principal la protección y aseguramiento, así como evitar la reiteración delictiva. Por ello, se ha hecho interesante la realización del presente trabajo, mediante el cual puede el lector adquirir los conocimientos necesarios para la comprensión de todos los ámbitos relacionados con tal concepto.
En la segunda parte, se abordará la explicación detallada de todos los elementos, presupuestos y procedimientos referentes con la que podría considerarse en la actualidad la medida cautelar más utilizada, el embargo preventivo, para hacer frente al cobro de deudas dinerarias no saldadas o con demora en su cumplimiento.
[EN] Precautionary measures are a very important role in practice, due to the importance they develop to ensure the proper functioning of the process, as well as serving as a channel to respond to the many demands which have as main purpose the protection and the assurance, as well as avoiding criminal reiteration. Therefore, it has been interesting the development of this work, through which the reader can acquire the necessary knowledge for the understanding of all areas related to this concept. In the second part, the detailed explanation of all the elements, budgets and related procedures with which the most used precautionary measure could be considered, the preventive freezing, to face the collection of unpaid or delayed monetary debts, will be addressed.
