Resumen
[ES] El presente proyecto abarca un estudio sobre la regulación de las medidas cautelares en el proceso civil, basándonos en los preceptos que se disponen sobre el tema en la Ley 1/2000, de 7 de enero, de Enjuiciamiento Civil. Se tomará en consideración desde la emanación de las medidas cautelares como derecho fundamental albergado en la Constitución Española, los caracteres y presupuestos esenciales para que tengan cabida dentro del proceso y finalmente el modo de proceder para su adopción. Es decisión el análisis en base al articulado que la Ley de Enjuiciamiento Civil dispone, al considerar preferente el estudio individualizado de cada artículo y las deducciones que de estos se pueden desprender, a diferencia de las tan diversas estructuras que numerosos estudios llevan a cabo.
[EN] This project encompasses a study about the regulation of precautionary measures in the civil procedure, based on the precepts about this subject included in Law 1/2000, of January 7, on Civil Procedure. Several issues such as precautionary measures as a fundamental right lodged in the Spanish Constitution, the essential characteristics and requirements - so that they have a place in the procedure - and the way to proceed for their adoption will be taken into consideration. This analysis of the articles that the Civil Procedure Law provides, is due to the preference for an individualized study of each article and the deductions that can be derived from them, unlike the diverse structures that numerous studies have carried out.
