Resumen
[ES] El objetivo de este trabajo es presentar una reflexión del papel que
realiza la negociación colectiva en materia de igualdad de trato y
oportunidades en las empresas. España ha ido regulado, conforme
la legislación internacional y comunitaria, la situación
desfavorable de la mujer en el mercado laboral. La Ley Orgánica
3/2007, de 22 de marzo, de la Igualdad Efectiva de hombres y
mujeres, ha supuesto un punto de inflexión para la logro de la
igualdad laboral, conjugando los derechos de conciliación con los
derechos laborales, entre otros. Además, ha implantando
instrumentos para su consecución, como son los Planes de
Igualdad u otras medidas adecuadas con la finalidad de llegar a la
igualdad efectiva entre hombres y mujeres en las empresas. Por
último, se analizan diferentes convenios colectivos, tanto cláusulas
antidiscriminatorias, como el modo de aplicar los Planes. Para ello
contamos con el trabajo de la Inspección de Trabajo, encargada de
la supervisión de la discriminación laboral.
[EN] The aim of this paper is to present a reflection of the role that makes collective bargaining on equal treatment and opportunities in business. Spain has been regulated under international and Community law, the unfavorable situation of women in the labor market. The Organic Law 3/2007 of 22 March on Effective Equality between men and women, has been a turning point for the achievement of employment equity, combining conciliation rights to labor rights, among others. It has also implemented tools to achieve them, such as equality plans or other appropriate in order to reach effective equality between men and women in business measures. Finally, different collective agreements are analyzed, both anti-discrimination clauses, such as how to implement the Plans. For this we have the work of the Labour Inspectorate, responsible for the supervision of employment discrimination.
