LA MEDIACIÓN COMO EL MEJOR MECANISMO DE RESOLUCIÓN DE CONFLICTOS EN LA EMPRESA FAMILIAR

Abstract

[ES]El principal interés en la elaboración de este trabajo fin de grado reside en conocer como el proceso de mediación se presenta como el método de resolución de conflictos más adecuado y factible para la empresa familiar. Tanto la empresa familiar como el proceso de mediación están adquiriendo una destacada importancia en España, de ahí que considere necesario su estudio. Para lograr este objetivo explicaremos por un lado todo lo que rodea a la empresa familiar, y por otro lado, analizaremos por qué se producen conflictos dentro de la misma y como se resuelven, con el fin de conocer por qué la mediación se presenta como la mejor alternativa para su solución, tanto por la propia naturaleza de la empresa familiar como por las propias características del proceso mediador.[EN]The main interest for the elaboration of this finish degree work lies in knowing how the mediation process is presented as the most appropriate and feasible method to solve conflicts for the family business. Both figures are getting back a distinguished importance in Spain, hence I consider necessary to study them. To reach this goal we will explain, in the one hand everything that involves the family business, and on the other hand, we will analyse why conflicts take place inside the same and how they are solved, with the purpose of knowing why the mediation is presented as the best alternative to solve them, both, for the own nature of the family business and for the characteristics of the mediating process itself.
