El juicio de desahucio por impago de la renta y cantidades debidas

Abstract

[ES]España siempre se ha caracterizado por presentar una sociedad principalmente propietaria en lo referente a la vivienda, dejando de lado otras alternativas habitacionales como el alquiler. Sin embargo, esta situación ha cambiado a lo largo del presente siglo, principalmente a raíz de la reciente crisis económica. La regulación de esta materia se caracteriza por presentar dos polos opuestos: el derecho sustantivo, regulador de los arrendamientos urbanos, tiende a proteger al arrendatario, mientras que el procesal, regulador del juicio de desahucio, tiende a equilibrar la balanza. En este sentido, se han sucedido diversas reformas procesales a lo largo del presente siglo orientadas a liberalizar y potenciar este mercado y proporcionar una mejor tutela de los derechos del propietario mediante la creación de procesos ágiles y sin dilaciones.

[EN]Spain has always been characterized for presenting, principally, a society which owns property related to the housing market, forgetting about other housing alternatives like renting. Nevertheless, this situation has changed throughout this present century, principally due to the recent economic crisis. Presenting two opposed poles characterizes the regulation of this subject: the substantive law, regulator of the urban housings, tends to protect the householder, while the procedural law, regulator of the eviction judgement, tends to keep the balance. In this sense, diverse procedural reforms happen throughout the XXI century, focused to liberalize and enhance this market and to provide a better protection to the householders ́ rights thanks to the creation of agile and without delays proceedings which permit giving back the ownership of the house at the soonest possible time.
