DERECHO PENAL Y FÚTBOL PROFESIONAL: DOPAJE, AMAÑOS Y LESIONES DEPORTIVAS.

Abstract

[ES] El fútbol profesional se ha convertido ya no sólo en un espectáculo, sino que, por su magnitud económica y deportiva, se considera un fenómeno social que es entendido, visualizado y en su mayoría, practicado, en cada rincón del mundo. Sin embargo, hay muchas situaciones donde surgen actuaciones que inciden directamente en el prestigio de este deporte.

El objetivo es obtener una competición fiable, justa, libre y que se mantenga al margen de polémicas que giren en torno a cualquier tipo de corrupción deportiva. Para ello, en este trabajo se van a analizar dos situaciones, por un lado, el dopaje como instrumento para mejorar el rendimiento, y el amaño de partidos como determinación de resultado previamente pactado. Por otro, las lesiones deportivas que pudieran ocurrir durante un encuentro de fútbol y que pudieran ser potencialmente sancionables por el código penal. Todo ello en el marco del fútbol profesional.

[EN] Professional football has become not only a spectacle, but also, due to its economic and sporting magnitude, it is considered a social phenomenon that is understood, visualized and, in its majority, practiced, in every corner of the world. However, there are many situations that directly damage the prestige of this sport.

The aim is to obtain a reliable, fair and a free competition that stays out of controversies that revolve around any type of sports corruption. To sum up, this final degree work will analyze two situations, on the one hand, doping as an instrument to improve performance, and match-fixing as a result of previously agreed upon results. On the other, sports injuries that could occur during a football match and that could be potentially punishable by the penal code. All this within the framework of professional football.
