Abstract

La contratación electrónica genera un gran interés en el ámbito de Derecho Internacional Privado, ya que Internet supone un entorno internacional y deslocalizado. Al presentar estos rasgos en ocasiones no es viable dar respuesta a los conflictos que puede ocasionar la contratación electrónica a través de los regímenes jurídicos tradicionales e internos de cada Estado, y al no existir a día de hoy, en el ámbito de Derecho Internacional Privado, un sistema jurídico armonizado de los contratos electrónicos concluidos a través de Internet, tanto desde tanto en normas procesales, como desde el ámbito material, se originan dos preguntas esenciales. La primera, la determinación de la competencia judicial internacional y, la segunda, la ley aplicable.
