Análisis de la compatibilidad de las prestaciones de la Seguridad Social con el trabajo

Abstract

[ES] El objetivo principal de este Trabajo Fin de Grado es examinar las posibilidades de compatibilizar la percepción de las distintas prestaciones de la Seguridad Social con el ejercicio de una actividad laboral, ya sea por cuenta ajena o por cuenta propia, mediante el análisis tanto de la normativa de seguridad social vigente (sobre todo la Ley General de la Seguridad Social) como de la jurisprudencia existente en esta materia. En este caso, se estudiarán las distintas prestaciones del Sistema de la Seguridad Social de forma individualizada, aunque el examen de todas ellas se realizará siguiendo el mismo método de análisis: su regulación y régimen de incompatibilidades, haciendo especial mención a su compatibilidad con el trabajo. Las prestaciones objeto del estudio serán las siguientes: incapacidad temporal, maternidad y paternidad, riesgo durante el embarazo y durante la lactancia, incapacidad permanente, jubilación, pensión de viudedad y de orfandad, y desempleo.

[EN] The main objective of this Final Project is to examine the possibilities of combining the payment of different social security benefits and the exercise of a labour activity, either as working somebody else or as self-employment, by means of the analysis of the current social security regulations (especially the General Law on Social Security) and the existing case law in this area. In this case, the different benefits of the Social Security System will be studied individually, although the examination of all of them will be carried out through the same method of analysis: its regulation and the legal system of incompatibilities, making special reference to its compatibility with the work. The social security benefits under study will be the following: temporary disability, maternity, and paternity, risk during pregnancy and breastfeeding, permanent disability, retirement, survivor's and orphan's pension, and unemployment.
