Abstract

[ES] En este Trabajo de Fin de Grado se aborda un tema que a día de hoy conviene estudiar a fondo, ya que está presente en numerosos foros y en todos los soportes posibles: la Orden Europea de Detención y Entrega. El trabajo comienza con un análisis del Espacio de Libertad Seguridad y Justicia, uno de los pilares básicos del Proyecto Común Europeo, para a continuación analizar los principios que sustentan este mecanismo de reconocimiento mutuo. Además, se hace hincapié en la regulación de la ejecución de la Orden Europea de Detención y Entrega según la legislación Española, sin perder de vista la Decisión Marco que se proyecta sobre todos los Estados Miembros. Por último, se analizan dos casos totalmente diferentes, el de Melloni y el Puigdemont, respecto a los cuales se hace toda una recopilación jurisprudencial bastante interesante.

[EN] In this Final Degree Project, I approach a topic that is really convenient to study deeply, since it is present in numerous forums and in all possible supports: the European Arrest Warrant. The work begins with an analysis of the Area of Freedom Security and Justice, one of the basic pillars of the European Common Project, to then analyze the principles that sustain this mutual recognition mechanism. Moreover, I emphasize the regulation of the execution of the European Arrest Warrant according to Spanish legislation, without losing sight of the Framework Decision that is projected on all Member States. Finally, two totally different cases are analyzed, that of Melloni and Puigdemont, with respect to which a quite interesting jurisprudential compilation is made.
