Resumen
[ES] Actualmente, la Ley regula con carácter general dos vías diferentes para la tutela judicial declarativa, que son el juicio ordinario y el juicio verbal.
El siguiente estudio mostrará diferentes aspectos del juicio verbal que se encuentran regulados en los artículos 437 y ss. de la Ley de Enjuiciamiento Civil (LEC) de 2000 como cauce para solventar controversias que no exceden de 6.000 euros, así como, de todas las materias recogidas en el art 250 de esta Ley.
La reciente reforma por la Ley 42/2015 ha realizado importantes modificaciones en el juicio verbal con el fin de buscar un equilibrio mucho más justo entre la parte demandada y demandante, pero disminuyendo el principio de la oralidad que tanto lo caracterizaba
[EN]Currently, the Law regulates in general two different means for the declaratory legal protection, which are the ordinary trial and the verbal trial. The following study will show different aspects of verbal trial that are regulated in articles 437 et seg. of Law of Civil Procedure (LEC) of 2000 as a means to solve disputes that do not exceed €6,000, as well as, of all the areas included in article 250 of this Law. The recent reform by Law 42/2015 has made important changes in the verbal trial in order to seek a much fairer balance between the defendant and the plaintiff, but decreasing the principle of orality that characterized it so much.
