FRAUDES DEPORTIVOS

Abstract

[ES] Este trabajo se inicia con un epígrafe introductorio, a través del cual, he tenido la intención de plasmar la importancia que tiene el deporte hoy en día. A continuación, he querido hablar por una parte de la Ley 5/2010, ya que fue a través de esta Ley por la que el delito de fraudes deportivos tuvo su entrada en nuestro Código Penal. Lo siguiente será el estudio de la Ley 1/2015, en la que veremos la redacción vigente del artículo 286 bis 4, los cambios que esta nueva redacción ha traído consigo respecto a la Ley anterior y el análisis de los conceptos claves de esta reforma. Se hará una breve mención, por un lado, a las primas a terceros, y, por otro lado, el derecho comparado. Y como punto final, aportaré una conclusión donde se recogerá resumidamente las ideas principales aportadas en este trabajo intercalándose con mi opinión personal.

[EN] This work begins with an introductory section, through which, I have intended to capture the importance of sport today. Then, entering the subject that interests us most in this work, we see the criminal intervention in this crime of sports fraud; In the first place, I wanted to speak for a part of Law 5/2010, since it was through this Law that the crime of sports fraud had its entry into our Criminal Code. The following will be the study of Law 1/2015, in which we will see the changes that this new wording has brought with respect to the previous Law . A brief mention will be made, on the one hand, to premiums to third parties; and, on the other hand, the comparative law. And as a final point, I will provide a conclusion where the main ideas contributed in this work will be summed up with my personal opinion.
