EL PROCESO MONITORIO

Abstract

[ES] Mediante la realización del Trabajo Fin de Grado "El Proceso Monitorio", se tratará de inspeccionar de forma exhaustiva todos los aspectos referentes a este proceso, el cual ha llegado a convertirse en el procedimiento jurisdiccional civil más empleado en España, debido básicamente a su sencillez y gran utilidad.

Así pues, analizaremos los aspectos más básicos del proceso monitorio, desde su concepto hasta sus principales caracteres. Además, se ofrecerá una descripción pormenorizada de las distintas fases que componen el proceso monitorio, así como de las posibles conductas a las que puede optar el requerido o deudor.

Por último, y no menos importante, se analizarán las costas y tasas judiciales en referencia a este proceso, además de una pequeña síntesis del proceso monitorio europeo, y para finalizar un análisis estadístico sobre el proceso monitorio en España.

[EN] Through the completion of the Final Degree Project "The Monitorial Process", it will be a matter of exhaustively inspecting all the aspects related to this process, which has become the most used civil jurisdiction procedure in Spain, basically due to its simplicity and great utility.

Thus, we will analyze the most basic aspects of the payment process, from its concept to its main characteristics. In addition, a detailed description of the different phases that make up the order for payment procedure will be offered, as well as the possible behaviors to which the required or debtor may opt.

Last, but not least, the court costs and fees will be analyzed in reference to this process, as well as a brief summary of the European order for payment procedure, and to finalize a statistical analysis of the payment procedure in Spain.
