BASES ROMANÍSTICAS DE LA CODIFICACIÓN CIVIL EUROPEA

Abstract

[ES] El presente trabajo es un análisis sobre la influencia del Derecho romano en la codificación actual, influencia que se analiza al detalle en el Código civil español. Para realizar esta labor he analizado el Derecho romano en distintos bloques. En el primer bloque el análisis ha sido sobre el Derecho romano en la época romana. Este primer bloque abarca casi un milenio de historia y finaliza con la obra cumbre del Derecho romano: El Corpus Iuris Civilis. El segundo bloque trata sobre el Ius Commune, aquí analizo la influencia del Derecho romano en la creación de una Europa que comparte unas bases muy importantes. El tercer bloque aborda la codificación contemporánea, desde las ideologías que le dieron forma hasta los principales códigos paradigmáticos. Finalmente concluyo con los fundamentos romanísticos del Código Civil español los cuales son las huellas más explicativas de todo este proceso.

[EN] This work analyzes the influence of Roman Law in the current codification, an influence that is analyzed in detail in the Spanish Civil Code. To carry out this task I have analyzed Roman Law in different sections. In the first section, the analysis has been about Roman Law in Roman times. This first block covers almost a millennium of history and ends with the masterpiece of Roman Law: The Corpus Iuris Civilis. The second section deals with the Ius Commune, here I analyze the influence of Roman Law in the creation of one Europe that shares the same bases. The third section deals with contemporary coding, from the ideologies that shaped it to the main paradigmatic codes. Finally I conclude with the romanistic foundations of the Spanish Civil Code which are the most explanatory traces of this whole process.
