IGUALDAD Y NO DISCRIMINACIÓN POR MOTIVOS DE ORIENTACIÓN SEXUAL E IDENTIDAD DE GÉNERO

Abstract

[ES] La comunidad LGBTI está integrada por las personas que se identifican como gais, lesbianas, bisexuales, transexuales/transgénero e intersexuales. La igualdad y la no discriminación por motivos de orientación sexual e identidad de género se plantea hoy como una de las grandes asignaturas jurídicas pendientes para la consecución de una igualdad real y efectiva en todos los sectores de la sociedad. A lo largo de este trabajo se realiza una revisión teórica del origen de esta discriminación, centrándose en el marco jurídico que rodea a las personas LGBTI desde una perspectiva europea, nacional y autonómica; las consecuencias que esta discriminación tiene para las personas LGBTI; y las distintas respuestas dadas por la doctrina y la jurisprudencia respecto al asunto.

[EN] The LGBTI community is composed of those people who identify as gay, lesbian, bisexual, transsexual/transgender and intersexual. Equality and non-discrimination based on sexual orientation and gender identity is still considered as one of the most important issues for the achievement of a real and effective equality in society. Throughout this work, a theoretical review of the origin of this discrimination is performed, focusing on the legal framework that surrounds LGBTI people from an European, national and regional perspective; the consequences that this discrimination has for LGBTI people; and the different answers given by the doctrine and the jurisprudence regarding this matter.
