LA INCAPACIDAD TEMPORAL EN EL ACTUAL RÉGIMEN GENERAL DE LA SEGURIDAD SOCIAL

Abstract

[ES] En la actualidad, la prestación de incapacidad temporal constituye una de las prestaciones más complejas y problemáticas de nuestro sistema de la Seguridad Social. La finalidad de esta prestación es la necesidad de compensar la pérdida de ingresos ante la imposibilidad temporal de trabajar. Sin embargo, esta prestación ha sido objeto de múltiples reformas legislativas, derivadas de una obsesión del legislador por controlar el fraude y el absentismo laboral injustificado. Por este motivo, resulta necesario conocer el actual régimen jurídico de esta prestación, atendiendo a las últimas modificaciones legislativas introducidas. La participación de los diversos agentes implicados tanto en el pago de la prestación económica como en la cobertura de asistencia sanitaria dificulta enormemente la comprensión en la regulación y control de la incapacidad temporal.

[EN] At present, temporary incapacity benefit is one of the most complex and problematic benefits in our social security system. The purpose of this benefit is the need to compensate for loss of earnings due to temporary inability to work. However, this benefit has been the subject of numerous legislative reforms, stemming from a legislator’s obsession with controlling fraud and unwarranted absenteeism in the workplace. For this reason, it is necessary to know the current legal regime of this benefit, taking into account the latest legislative amendments introduced. The involvement of the various actors involved in both the payment of the financial benefit and the coverage of health care makes it very difficult to understand the regulation and control of temporary incapacity.
