EL DERECHO DE DEFENSA EN EL PROCESO PENAL

Abstract

[ES] El principal interés en la elaboración de este trabajo fin de grado radica en conocer cómo se estructura el proceso penal español ante los ciudadanos españoles, centrándonos en cómo funciona el derecho de defensa dentro del mismo. Puesto que, tanto el proceso penal español como el derecho de defensa son de vital importancia para la jurisdicción, de ahí que se considere necesario su estudio. Asimismo, en este estudio analizaremos los derechos fundamentales que se presentan como garantías a todas las personas cuando se ven involucradas en la situación de ser acusadas o investigadas por la comisión de hechos delictivos. Posteriormente, compararemos el derecho de defensa con el derecho de defensa de las personas jurídicas.[EN] The main interest in the preparation of this study lies in knowing how the Spanish criminal process is structured before Spanish citizens. We will focus on how the right of defense works within it. We consider necessary its analysis because both the Spanish criminal process and the right of defense are of vital importance for the jurisdiction. Also, in this study we shall analyze the fundamental rights that are presented as guarantees to all people when they are involved in the situation of being accused or investigated for the commission of criminal acts. Subsequently, we shall compare the right of defense with the right of defense of legal persons.
