Resumen
[ES] Este trabajo trata de la discrecionalidad judicial de la que dispone un juez a la hora de
tomar decisiones. Se indica cuáles son las causas que dan lugar a la discrecionalidad y
los elementos que la forman. También he expuesto las diferencias existentes entre los
dos lipos de discrecionalidad, la discrecionalidad judicial y la discrecionalidad
administrativa. He hecho referencia a la diferencia que existe entre la discrecionalidad y
la arbitrariedad porque son dos figuras jurídicas muy diferentes y que a veces se
confunden. Además, hablo sobre el importante papel que tienen los principios jurídicos
de nuestro Ordenamiento jurídico en la discrecionalidad y más en profundidad del
principio de proporcionalidad, el más utili:zado en la actualidad por los jueces. Por
último, expongo un caso real de una sentencia condenatoria del Tribunal Supremo a una
Magistrada por el delito de prevaricación porque actúa de forma arbitraria en una de sus
resoluciones.
[EN]This paper discusses the judicial discretion available to a judge when making decisions. Shown are the causes that give risc to the discretion and the elemcnts that form il. 1 have also stated the difterences between the two types of discretion, judicial discrction and administrative discretion. 1 have made reference to the difference between discretion and arbitrariness because they are two very different legal figures and that they are sometimes confused. 1 also talk about the important role that have the legal principies of our legal system in the discretion and more in depth of tbe principie of proportionality. the most widely used nowadays by the judges. Finally, 1 discuss a real case of a sentence of tbc Supreme Courl to a judge for the crime of prevarication bccause il acts arbitrarily in one of its resolutions
