IGUALDAD Y NO DISCRIMINACIÓN, UN CAMINO HACIA EL RECONOCIMIENTO PLENO DE LOS DERECHOS DEL COLECTIVO LGBTI

Abstract

La igualdad y no discriminación en lo referente a la orientación sexual y la identidad de género es uno de los temas que más controversia generan en la sociedad. Aunque en estas últimas décadas hemos sido testigos de un gran avance a favor del colectivo LGBTI, como la aprobación de igualdad de derechos en lo que a matrimonio y adopción se refiere, todavía queda mucho para que la sociedad muestre una aceptación total del colectivo. La comunidad LGBTI está compuesta por gais, lesbianas, bisexuales, transexuales e intersexuales. Este trabajo se centra en el marco jurídico a nivel europeo, nacional y autonómico en lo referente a esta discriminación. También se estudian las fobias y los delitos de odio contra el colectivo y un análisis jurisprudencial sobre la postura del tribunal europeo de los derechos humanos relacionados con este tema. Equality and non-discrimination, in relation to sexual orientation and gender identify, is one of the topics that most controversy identifies society. Although in recent decades we have witnessed a great advanced in favor of the LGBTI community, as the approval of equal rights in marriage and adoption is concerned, there is still much for society to show full acceptance of the community. The LGBTI community is made up of gays, lesbians, bisexuals, transsexuals and intersexes. This work focuses on the legal framework at European, national and regional level regarding this discrimination. Phobias and hate crimes against the community and a jurisprudential analysis of the position of the European Court of Human Rights related to this topic are also studied.
