LA PROVISIÓN DE LOS BIENES COMUNES DEL CONOCIMIENTO

Abstract

[ES] Los bienes comunes del conocimiento están a la orden del día, mientras que la legislación que los regula está un paso por detrás, y favorece de manera inimaginable nuestro problema a tratar: el cercamiento de los bienes comunes del conocimiento. Los creadores de contenido velan por recibir algún tipo de rendimiento de su creación, mediante patentes, derechos de protección, con los cuales la Ley los ampara. Mientras, el colectivo intelectual busca que cada vez más personas puedan tener libre acceso a todos los bienes comunes del conocimiento, y de crear unas leyes y normas que permitan esta situación. Pero, ¿qué incentivos tienen los creadores de contenido para dejar su obra en acceso libre?

[EN] The common goods of knowledge are the order of the day, while the legislation that regulates them is one step behind, and favors in an unimaginable way our problem to be addressed: the enclosure of the common goods of knowledge. The creators of content ensure that they receive some type of performance from their creation, through patents, protection rights, with which the Law protects them. Meanwhile, the intellectual collective seeks that more and more people can have free access to all the common goods of knowledge, and create laws and regulations that allow this situation. But what incentives do content creators have to leave their work in free access?
