Resumen
[ES] La elección de este tema se debe a la importancia de preservar el medio ambiente desde
un punto de vista jurídico en base a dos vertientes: Por un lado, una categorización del
medio ambiente como derecho humano en concreto como derecho de tercera generación
y su protección internacional y a partir de ahí, la consideración de las graves y dolosas
agresiones al medio ambiente como posibles crímenes contra la humanidad. Los Estados
cada vez son más conscientes de la importancia de la conservación del medio ambiente y
de la necesidad de su protección. Se ha realizado una labor esencial entre los Estados y
las distintas instancias internacionales para lograr establecer unas pautas a seguir tras la
toma de conciencia tanto colectivamente como sociedad como de forma individual de la
necesidad de conservar y proteger el medio ambiente. Sin menoscabar estos esfuerzos,
estos se muestran insuficientes y existen numerosas lagunas en la materia. A partir de esta
premisa para solucionar estos problemas se plantea la posibilidad de considerar lo delitos
más graves contra el medio ambiente como crímenes de la humanidad.
[EN] The election of this topic is caused by the importance of preserving the environment from a legal point of view from two aspects: On the one hand, a categorization of environment alike human rights or third generation right and on the other hand, the regulation of its protection related to international law, from there, the consideration of serious and malicious aggressions to the environment as possible crimes against humanity. States are becoming more aware about the need of its protection, and they have done an important labour to achieve the establishment of steps to follow, and that of an individual and collective awareness of environmental protection. Without undervaluing this labour, nowadays it is obvious the attempts haven't proven sufficient. From this precept to solve these issues, it's settled up to consider environmental felonies as crimes against humanity.
