Resumen
[ES] Este proyecto está basado en el proceso capacidad, filiación, matrimonio y menores regulado en el Libro IV, Título I de la Ley 1/2000, de 7 de enero de Enjuiciamiento Civil. Dentro de este proceso señalamos las acciones de reclamación de la maternidad y paternidad ya sean matrimoniales o extramatrimoniales.
Para investigar este proceso debemos de referirnos a las acciones citadas. Primeramente se ha de presentar una demanda con un principio de prueba y posteriormente se tendrá en cuenta la intervención del Ministerio Fiscal para representar al menor. Una vez que estas acciones de impugnación hayan sido ejercitadas por quienes tienen legitimación para ello y dentro del plazo establecido estipulado por el Código Civil, se procederá a la investigación de la maternidad y la paternidad a través de toda clase de pruebas siempre y cuando las mismas no afecten a los derechos fundamentales tanto del hijo como los de los progenitores.
[EN] This proyect is base on one of the spatial judicial processes, more specifically in the process capacity, affiliation, marriage and minors regulated in Book IV, Title I of Law 1/2000, of January 7, on Civil Procedure. Within this process we look at the processes of affiliation, pointing out the actions of claiming motherhood and paternity whether they are married or extramarital. To investigate the process of challenging motherhood and paternity, we must refer to the impeached actions, in this process first a lawsuit is filed with a principle of evidence and subsequently an intervention by the Public Prosecutor's Office to represent the child, this has active legitimacion. When actions of impeached are exercised by those who have legitimacion, and within the time limit set by the Civil Code. I will investigate motherhood and parenthood with evidence. These evidence can`t affect the fundamental rights of the child and the protectors.
