PAPEL DE LA DISCRECIONALIDAD JUDICIAL EN CONFLICTOS ENTRE DERECHOS Y PRINCIPIOS

Abstract

[ES] En el presente trabajo se realiza un análisis del concepto de la discrecionalidad judicial, deteniéndonos en las distintas facetas que puede tener en su aplicación práctica y haciendo especial hincapié en uno de sus elementos: el principio de proporcionalidad. Sobre este último, profundizaremos en sus orígenes, requisitos, y uso en la actualidad para la resolución de conflictos entre normas y principios, a través de múltiples recursos que se han ido generando a lo largo del tiempo, como el test de proporcionalidad alemán. Finalmente, se presentan varios ejemplos en la jurisprudencia donde se pondrán de manifiesto todos los elementos y recursos vistos a lo largo del trabajo.[EN] In the following work an analysis of the concept of judicial discretion is carried out, stopping in the different facets that it can have in its practical application and emphasizing specially one of its elements: the principle of proportionality. Next, we will deepen its origins, requirements, and its use nowadays in the resolution of conflicts between norms and principles, through multiple resources that have been generated over time, such as the german proportionality test. Finally, several examples are presented in the jurisprudence where all the elements and resources seen throughout the work will be perceived.
