ANÁLISIS DE LOS NUEVOS DELITOS DE FINANCIACIÓN ILEGAL DE LOS PARTIDOS POLÍTICOS.

Abstract

[ES] En este texto se va a presentar un estudio donde se va a analizar los novedosos delitos de financiación ilegal introducidos con la reforma de la Ley Orgánica 1/2015, en los artículos 304. Bis y 304. Ter, Título XIII Bis, bajo la rúbrica de los Delitos de Financiación Ilegal de los Partidos Políticos. Se van a abordar cuestiones que son relativas a estos delitos tipificados por el legislador. Un aspecto muy importante es la aplicación por parte de legislador del uso de las normas penales en blanco que como se observará ha sido ampliamente criticado. Estamos ante unas figuras jurídicas bastantes criticadas por distintos autores y que debido a su novedad hay poca escritos en lo que atañe a este estudio.

[EN] The following text shows a general study where we can analyze the novel crimes of illegal financing introduced with the reform of the Organic law in articles 305, Ter, title XIII Bis under the heading of illegal financing offenses of political parties. For that reason, it is an important issue for the legislator. A very important aspect is the application by the legislator of penal blank penal laws that as it was observed has been widely criticized. We are dealing with a few legal figures criticized by different authors due to its novelty, there is few papers regarding this study.
