Una aproximación jurídica a los centros de internamiento de extranjeros

Abstract

[ES]El Centro de Internamiento de Extranjeros (CIE) es una medida cautelar adoptada por el Estado para asegurar la expulsión de inmigrantes ilegales. En el presente trabajo se analizan, en primer lugar, las causas y el procedimiento de ingreso en un CIE para después diseñar estrategias defensivas que permitan evitar detenciones o ingresos ilegales. En una segunda parte se estudia el estatuto jurídico del extranjero dentro de estos centros y el nuevo Reglamento que los regula a fin de señalar los avances, las carencias y las propuestas de mejora de esta nueva regulación. Finalmente se examina como se ejecuta la medida de expulsión una vez el inmigrante sale del CIE. Además, en esta última parte se estudian las expulsiones exprés, los vuelos macro y las devoluciones en caliente, pues estas formas de expulsión están superando en número a las expulsiones desde los CIE.

[EN]Immigrant Detention Centres are a precautionary measure adopted by the state in order to ensure the expulsion of illegal immigrants. This paper analyses, firstly, the causes and the procedure that lead to the entry in these centres in such a way that defensive strategies can be designed to avoid illegal detentions. Secondly, inmates „legal status as well as the new regulations about these centres will be examined. All of this in order to determine the improvements that have been made, the problems that remain to be addressed and the measures that could be taken to ameliorate the situation. Finally, it is studied the execution of the expulsion once the immigrant has been set free. Moreover, in the last part, express migrant deportations, flights to send back immigrants to their countries and the imminent deportations to Morocco are analysed given the fact that these kinds of expulsions are increasing nowadays.
