EL DERECHO DE DEFENSA EN EL PROCESO PENAL

Abstract

Este trabajo aborda como tema principal el derecho de defensa como derecho fundamental que garantiza al investigado o encausado defenderse de los hechos que se le imputan en el proceso penal. Su evolución en los ámbitos internacionales y comunitarios ha dado lugar a multitud de tratados y convenios, que han llevado al desarrollo de instrumentos y mecanismos de cooperación para establecer sistemas jurídicos comunes que protejan y refuercen los derechos procesales. En España, analizaremos este derecho que se encuentra presente dentro de la norma suprema, la Constitución, y a su vez en la Ley de enjuiciamiento criminal. Así como estudiaremos las continuas modificaciones que ha sufrido la LECrim y que nos llevan a la amplia lista de garantías que contiene actualmente el derecho de defensa. The main matter of this study is the right to defense, which is considered to be a fundamental right which ensures the chance for the defendants to take part in the penal procedure in which they are involved. The evolution of the right to defense in international and community levels deals to several treaties and agreements which have resulted in the development of cooperation mechanisms and documents to establish common legal systems which protect and reinforce the procedural laws. The right to defense will be analyzed in the context of our country, Spain. It can be found in the Constitution, the supreme regulation, and, moreover, in the Law of Criminal Procedure. At the same time, the constant reforms of this Law will also be studied. These modifications lead us to a series of guatentees, which are currently included in the right of defense.
