LAS AYUDAS PÚBLICAS Y EL CONFLICTO ENTRE AIRBUS Y BOEING

Abstract

Tras más de quince años de disputas ante la Organización Mundial del Comercio, el conflicto entre la Unión Europea y Estados Unidos de América sobre las ayudas públicas concedidas a sus respectivos productores aeronáuticos -Airbus y Boeing continúa acentuándose y mostrando las peores facetas de una guerra comercial. Dicha intervención se muestra necesaria por la naturaleza del sector y por su posición clave para el desarrollo de las políticas económicas y comerciales de una y otra parte. Sin embargo, hasta la fecha, el apoyo estatal parece haber traído más problemas que soluciones. Este trabajo explora la realidad del conflicto desde un punto de vista jurídico, haciendo hincapié en la regulación de las ayudas públicas con la intención de esclarecer y actualizar la situación de dicho régimen normativo y analizar su aplicación práctica con un ejemplo tan significativo como es el de la aviación civil. After more than fifteen years of disputes before the World Trade Organization, the battle between the European Union and the United States of America over state aid granted to their civil aircraft manufacturers -Airbus and Boeing- continues escalating and showing the worst facets of a commercial war. Such public intervention appears necessary due to the nature of the sector and to its key role in promoting both sides economic and commercial policies. Nonetheless, up until now, public support in the form of subsidies seems to have brought more troubles than solutions. This paper explores the reality of the conflict from a legal point of view, focusing on the regulation of state aid with the aim of clarifying and updating the situation of this normative regime, and trying to analyze its practical implications in such a significant case as the civil aviation market.
