REFORMA DEL SISTEMA DE MARCAS EUROPEO Y SUS CONSECUENCIAS EN LA LEGISLACIÓN ESPAÑOLA

Abstract

[ES] Este Trabajo Fin de Grado está enfocado en el paquete de reforma legislativa del sistema de marcas de la Unión Europea y sus consecuencias en el Derecho español. Para ello detallaremos el concepto de marca en sentido económico y jurídico así como las clases de marca, las funciones y los niveles de registro. A continuación, analizamos toda la evolución normativa europea de las marcas, tanto Directivas como Reglamentos, concluyendo en la reforma del sistema de marcas con la publicación de la Directiva 2015/2436 y el Reglamento 2015/2424. Asimismo se realiza una comparación de la Ley de Marcas 17/2001 con el Anteproyecto de la Ley de Modificación parcial de la Ley 17/2001 que entrará en vigor en enero de 2019.

[EN] This Project is focused on the legislative reform package of the European Union trademark system and its consequences in the Spanish law. We will detail the economic and legal concept of trademark as well as the categories of the trademark, functions and registration tier. Then we analyze the European regulation evolution of trademarks, Directives and Regulations, concluding in the trademark system reform with the Directive (UE) 2015/2436 and the Regulation (EU) 2015/2024. In addition, we make a comparison between the Trademark Law 17/2001 and the Preliminary draft of the partial modification of Trademark Law 17/2001 that put into effect in January 2019.
