ANÁLISIS COMPARATIVO DE LAS PRINCIPALES NOVEDADES DE LA LEY DE PATENTES 24/2015

Abstract

[ES]Este Trabajo de Fin de Grado está orientado, fundamentalmente, al análisis comparativo de las principales novedades introducidas por la actual Ley 24/2015 de Patentes, en comparación con lo regulado en la anterior Ley 11/1986. En primer lugar, se analizarán los motivos desencadenantes de la reforma, se mostrará la estructura de la actual Ley, y se mencionarán las principales novedades de la reforma. En segundo lugar, ante la gran diversidad de cambios que ha dado lugar la Ley 24/2015, de 24 de julio, de Patentes, se han analizado cinco puntos principales de estudio. Los cuáles, son los siguientes: 1. Las disposiciones preliminares. 2. La patentabilidad. 3. La solicitud y el procedimiento de concesión de patentes. 4. Los certificados complementarios de protección. 5. Los modelos de utilidad. Para concluir, se analizarán algunos de los efectos que se han producido con la reforma de la Ley 24/2015, de Patentes.

[EN] Essentially, this project is oriented to the comparative analysis of the main novelties introduced by the current Law 24/2015 of Patents, in comparison with what is regulated in the previous Law 11/1986. On the one hand, the reasons and the main novelties of the reform will be analyzed and also, the structure of the current law will be studied. On the other hand, there are a wide range of changes in the Law 24/2015, of July 24, of Patents, but in this project, only five important novelties will be analyzed in depth. These are the following: 1. The preliminary dispositions. 2. Patentability. 3. The application and the procedure to grant the patent. 4. The complementary certificates of protection. 5. Utility models. Finally, some of the consequences of the reform of the Law 24/2015, of Patentswill be examined.
