Resumen
[ES] La relevancia de este trabajo reside en el desarrollo de la cultura jurídica romana y su proyección en el modelo de Estado democrático. La Constitución romano-republicana es el marco jurisprudencial del derecho, de tal forma que es de especial transcendencia la identidad del elemento jurídico del modelo democrático que va a ser el objeto de estudio. Pues hizo constituir un tipo de Estado bajo la denominación de res publica romana, en la cual se comenzó a hablar de democracia y autoridad ejercida por el pueblo. Inicio así con una visión de la historia de Roma, ya que la considero como el origen del que emanan reglas y axiomas jurídicos, teniendo siempre presente, en sentido más especial a su fuente principal, la Compilación Justinianea. La República romana evolucionó gracias a la fuerte influencia por la lucha entre la aristocracia, estableciendo dos de los tres pilares más importantes del régimen, el Senado y los ciudadanos. La libertad por tanto va a ser la meta del derecho individual, aunque la confianza de la misma únicamente puede ser proporcionada por la ley integrada en un sistema normativo como garante.
[EN] The relevance of this work lies in the development of Roman legal culture and their projection over the model democratic state. The Roman Republican Constitution is the jurisprudence law framework of law, therefore it’s especially important the identity of legal component of this democratic model which will be the study objective. This model made a type of state under the name of Roman res publica, which started speaking about democracy and authority exercised by people. Beginning then an overview of Roman history began, because I consider it as the source where comes from every legal axioms and rules, bearing in mind, the most special meaning to the main source, Justinian Compilation. The Roman Republic evolved thanks to the strong influence by the struggle between the aristocracy, establishing two of the three major pillars of the regime, Senate and citizens. Freedom therefore will be the goal of individual rights, though the same confidence can only be provided by an integrated system in a regulatory act as guarantor.
