Resumen
El desarrollo de las TIC ha propiciado la aparición de nuevos
modos de relacionarse entre consumidores y empresas, y con ellos
la necesidad de regular otro tipo de contratos acordes a las nuevas
tecnologías. El uso generalizado de las nuevas tecnologías de la
información y el fácil acceso a Internet permite tanto a empresario
como a consumidores, una nueva manera de contratar: la
celebración de un contrato online. La contratación electrónica
elimina barreras geográficas, lo que va a suponer que las partes
contratantes puedan llevar a cabo la celebración del contrato sin
necesidad de estar presentes en el mismo lugar físico. A su vez,
esto propicia la aparición de nuevos derechos, y medidas para
protegerlos.
The development of ICTs has led to the emergence of new ways of interacting between consumers and companies, and with them the need to regulate other types of contracts in accordance with new technologies. The widespread use of new information technologies and easy access to the Internet allows both employers and consumers a new way of contracting: the conclusion of an online contract. Electronic contracting eliminates geographical barriers, which will mean that the contracting parties can carry out the contract without having to be present in the same physical place. In turn, this encourages the emergence of new rights, and measures to protect them.
