Análisis del delito de daños al Patrimonio Arqueológico. Artículo 323 y 324 tras la reforma del Código Penal por la L.O 1/2015.

Abstract

En el presente trabajo se estudiarán los delitos que sobre el patrimonio cultural español pueden cometerse, ahondando en el delito de daños al patrimonio arqueológico, el cual se encuentra tipificado dentro del delito de daños en bienes de valor cultural (art.323 CP) y el delito de daños por imprudencia grave a los bienes culturales (art. 324 CP). Ambos preceptos afectados por la reforma del Código Penal por la L.O 1/2015. Una de las cuestiones más interesantes a analizar será aquella que recae sobre la redacción del tipo delictivo referente a “bien arqueológico”, teniendo que tomar postura sobre la necesidad o no de una declaración administrativa previa del bien para así poder prosperar a la posterior sanción penal. Palabras clave: delito de daños; delitos al patrimonio cultural; patrimonio histórico; patrimonio arqueológico; valor cultura This work will examine the crimes that can be committed on the Spanish cultural heritage, deepening the crime of damage to the archaeological heritage, which is typified within the crime of damage to property of cultural value (art.323 CP) and the crime of serious recklessness damage to cultural property (art. 324 CP). Both precepts affected by the reform of the Penal Code by L.O 1/2015. One of the most interesting questions to discuss will be the one that falls on the wording of the type of criminal concerning "archaeological well", having to take a position on the need or not of a prior administrative declaration of the good in order to be able to prosper on the subsequent criminal sanction.
