Resumen
El principio de la inviolabilidad está, más que nunca, a
debate en la sociedad española, más si cabe que cuando se
introdujo en nuestra Constitución, sin embargo, hay pocas
herramientas y estudios acerca de esta figura y sobre su
interpretación. El objetivo del presente trabajo es esclarecer, en
cierta medida, las sombras que existen y aportar claridad jurídica
sobre la figura. Para tal fin se realizará un estudio del principio de
la inviolabilidad, junto con una aproximación a la existencia del
principio en otras constituciones europeas, para finalizar con un
profundo análisis de la figura en la actualidad, la importancia del
derecho penal para su interpretación y de las distintas posturas
doctrinales relativas a la misma.
The principle of inviolability is, more than ever, under debate in Spanish society, even more so than when it was introduced in our Constitution, however, there are few tools and studies about this figure and its interpretation. The objective of this paper is to clarify, to a certain extent, the shadows that exist and provide legal clarity on the figure. To this end, a study of the principle of inviolability will be carried out, together with an approach to the existence of the principle in other European constitutions, to end with a deep analysis of the current figure, the importance of criminal law for its interpretation and of the different doctrinal positions relative to it.
