El ámbito temporal del convenio colectivo: la problemática de la “ultraactividad”

Abstract

[ES] Desde el originario texto del Estatuto de los Trabajadores, el legislador introdujo un mecanismo denominado “ultraactividad” para permitir la prórroga indefinida de cláusulas normativas de los convenios. Sin embargo, con la reforma legal de 2012 se introducen modificaciones que rompen con la línea de tendencia clásica. En este trabajo estudiaremos una de las mayores novedades de la reforma, el nuevo tratamiento de la ultraactividad con el objetivo de acelerar los procesos de negociación y evitar la petrificación de las condiciones de trabajo pactadas en el convenio.

[EN] Since the original text of the Workers’ Statute, the Spanish legislator introduced a mechanism called “ultra-activity” to allow the indefinite extensión of the normative clauses of the agreement. Nevertheless, the legal reform in 2012 introduced significant changes that break with the classic trend lines. In this paper we will study one of the most important changes of the reform, the new treatment of the ultraactivity, with the objetive to speed up the negotiation process and to avoid the pretrification of the terms and conditions reached in the agreement.
