UNIFICACIÓN LEGISLATIVA DEL DERECHO PRIVADO EN EUROPA: LA HIPÓTESIS DE UN IMPROBABLE CÓDIGO CIVIL EUROPEO

Abstract

[ES] En el presente trabajo se analiza, en primer lugar, el desarrollo del Derecho privado en Europa a lo largo de la historia moderna, y también se explican los conceptos de Derecho comunitario, Derecho internacional y Derecho privado más enfocado en la actualidad. A continuación, se expone el proceso de “comunitarización” del ámbito de la cooperación judicial civil, y su relación con los diferentes Tratados de la Comunidad. Por último, se concluye exponiendo la hipótesis de la creación de un Código civil europeo, detallando sus ventajas en caso de realizarse, así como los impedimentos que hacen que hoy en día esta codificación legislativa resulte poco factible.

[EN] In this memory it has been analysed, firstly, the development of private law in Europe along the modern history, and also explains the definitions of community law, international law and emphasising on the private law concept. After that, the process of “communitarization” on the field of civil judicial cooperation has been exposed, based on several EU Treaties over the years. And finally, this memory has been concluded by stating the hypothesis of the creation of an European Civil Code, explaining its advantages and disadvantages, as well as the impediments that make this legislative codification unlikely nowadays.
