El delito de apropiación indebida tras la reforma LO 1/2015

Abstract

[ES] El presente Trabajo de Fin de Grado tiene como objeto analizar la nueva regulación del delito de apropiación indebida en el Código Penal español tras la reforma operada por la Ley Orgánica 1/2015, de 30 de marzo.

Para ello se analiza la antigua estructura del delito de apropiación indebida, recogido en el artículo 252 del Código Penal de 1995, y los distintos posicionamientos doctrinales y jurisprudenciales que han tenido lugar durante sus dos décadas de vigencia hasta la Reforma de 2015. Para finalmente, analizar el tipo actual de este delito, recogido en el artículo 253 CP.

Debido a su tortuosa relación, se analiza, más brevemente, el antiguo delito de administración desleal societaria del artículo 295 CP, y su nueva redacción recogida en el artículo 252 CP, perteneciente ahora al Capítulo de delitos contra el patrimonio y el orden socioeconómico.

The present End of Degree Work is about the analysis of the new regulation of the crime of misappropriation in the Spanish Penal Code after the reform operated by Organic Law 1/2015, March 30.

For that, It is analyzed the old structure of the crime of misappropriation that is contained in article 252 of the Criminal Code of 1995, as well as, the different doctrinal and jurisprudential positions that have taken place during its two decades of validity until the Reform of 2015. Finally, to analyze the current type of this crime, contained in article 253 CP.

Due to its tortuous relationship, it analyzes, more briefly, the old crime of unfair administration of article 295 CP, and its new wording contained in article 252 CP, now belonging to the Chapter of crimes against patrimony and socioeconomic order.
