Resumen
[ES]La vivienda es fundamental para el desarrollo del sujeto y para la vida en sociedad, ya
que, por medio de esta se otorga una privacidad y un escenario donde desarrollar la vida
familiar, el Derecho a la vivienda digna, relaciona dicho Derecho con la dignidad del
individuo.
Este Derecho se encuentra regulado en el artículo 47 de nuestra Constitución Española
del año 1978, así como en Tratados Internacionales, como la “Declaración Universal de
Derechos” o el “Pacto Internacional de Derechos Económicos, Sociales y Culturales”.
El presente trabajo trata del estudio de la situación del Derecho de la vivienda digna en
nuestro ordenamiento jurídico, con la finalidad de determinar si realmente llega a
garantizarse la vivienda digna a nuestra sociedad.
Finalmente, se concreta el estudio centrándose en la Leyes andaluzas 13/2005 y 4/2013
de 1 de octubre, así como las resoluciones del Tribunal Constitucional que ha habido a
su respecto.
[EN]The housing is a fundamental for the individual development and for society as it provides them a privacy and scenario to develop a family life. Therefore, the right to adequate housing relate that right with the dignity of the individual. This right is regulated by the article 47 in our Spanish Constitution of 1978 as well as by International Treaties such as the “Universal Declaration of Human Rights” or the “International Covenant on Economic, Social and Cultural Rights”. This work deals with the study of the situation of the right to adequate housing in our legal system, related to the economic scenario of the housing with the purpose of determining whether the right to adequate housing is, in fact, guaranteed. Finally, this study focuses on the Andalusian Laws 13/2005 and 4/2013 of 1st October as well as the resolutions of the Constitutional Court (Spain) that have been published in that regard.
