La posibilidad de adoptar medidas cautelares en el proceso civil deviene por la instauración en la Constitución Española del derecho fundamental a la tutela judicial efectiva (artículo 24), asegurándose la efectividad de la futura sentencia estimatoria que recaiga del proceso, la cual puede verse desprovista de efectividad debido a las conductas fraudulentas del demandado durante la pendencia del proceso. El objetivo del presente trabajo será conocer a fondo esta institución procesal así como la regulación de la misma.
[EN] The possibility of adopting precautionary measures in the civil procedure comes about the establishment of the effective legal protection as a fundamental right on the Spanish Constitution (article 24), guaranteeing the effectiveness of the future final judgement that falls to the procedure, judgement that could be devoid of effectiviness because of a fraudulent conduct of the defendant during the pendency of the procedure. The goal of this work is to know in the depth this procedural institution as well as its legal regulation.
