AYUDAS DE ESTADO. DE LOS "TAX RULING" A LOS PARAÍSOS FISCALES INTERIORES.

Abstract

[ES] Actualmente, uno de-los temas que más repercusión está causando a nivel europeo es la prestación de ayudas estatales ilegales generadas por una multitud de acuerdos fiscales secretos, que establecen posiciones de ventaja subjetivas para empresas con determinado perfil. Han estallado varios escándalos referentes a este tema y la Unión Europea ha establecido como uno de sus grandes objetivos luchar contra este tipo de fraude y buscar la colaboración de todos los Estados miembros para conseguirlo, comenzando con un buen control e investigación de las ayudas estatales que se dan en la Unión por parte de los Estados, para declararlas legales y compatibles con el mercado interior o por el contrario, declararlas ilegales y proceder a su recuperación.

[EN] Currently, one of the issues that is causing more impact at European leve/ is the provision of illegal state aid generated by a multitude of secret tax agreements, which establish positions of subjective advantage for companies with a certain profile. Severa/ scandals have erupted on this issue and the European Union has established as one of its major objectives to fight against this type of fraud and seek the collaboration of ali Member States to achieve it, starting with a good control and investigation of state aid they are given in the Union by the States, to declare them legal and compatible with the interna/ market or, on the contrary, to declare them illegal and to proceed with their recovery.
