EL MALTRATO PSICOLÓGICO COMO JUSTA CAUSA DE DESHEREDACIÓN DE HIJOS Y DESCENDIENTES

Abstract

[ES] La desheredación se presenta en nuestro ordenamiento como mecanismo de exclusión del legitimario en la herencia del causante cuando concurren algunas de las causas legalmente tipificadas. Si bien la interpretación restrictiva de las causas de desheredación ha marcado la jurisprudencia en este ámbito, el reciente pronunciamiento del Tribunal Supremo en cuanto a la inclusión del maltrato psicológico como maltrato de obra viene cuestionando qué situaciones podrían constituir causa de desheredación. Es objeto de este trabajo realizar una revisión doctrinal y jurisprudencial respecto a las causas de desheredación y aportar una visión de las conductas familiares subsumibles en el artículo 853.2 del Código Civil.

[EN]Disinheritance represents in our legal system a mechanism to exclude the person entitled to a legitime from the testator’s heritance when any of the legal causes occur. Even if the restrictive interpretation of the causes of disinheritance has determined the jurisprudence in this extent, the recent consideration of the Supreme Court of the psychological abuse as a mistreatment has been questioning which situation could be considered as a disinheritance cause. The aim of this project is to review the doctrine and jurisprudence about the causes of disinheritance and to contribute a vision of the familiar behaviours that can be included in the article 853.2 of our Civil Code.
