CONFIGURACIÓN JURÍDICA DE LA LEGÍTIMA. REFLEXIONES SOBRE SU FUTURO

Abstract

[ES] La legítima es una institución de largo recorrido histórico cuya función social y económica se cuestiona en la actualidad. Este Trabajo de Fin de Grado tiene como objetivo estudiar las perspectivas de futuro que tiene el sistema de legítimas del Código Civil. Partiendo de su configuración jurídica actual, se analizan detalladamente las últimas reformas que han afectado a la regulación de la legítima y se exponen los argumentos que defienden su mantenimiento o modificación. Asimismo, se recoge un estudio comparativo de este sistema de legítimas con el de los distintos Derechos forales de nuestro país.

[EN] The legitimate is an institution with a large historic presence, which social and economic function is questioned nowadays. This Final Degree Project has the purpose of study the future prospecta that the legitimate system of the Civil Code has. Starting from its current legal form, it is analyzed in detail the latest reforms which have modified the legitimate regulation and it is exposed the arguments that defend its current system or its change. Also, a comparative study between the legitimate system and the different statutory Laws of our country is included.
