Principio de autonomía de la voluntad y rupturas matrimoniales

Abstract

[ES]El objetivo fundamental del trabajo es investigar un poco más sobre el principio de autonomía de la voluntad y los pactos prematrimoniales a los que pueden llegar los cónyuges en previsión de una ruptura de su matrimonio. Hablaremos de los límites de dicho principio, de la relación del mismo con el concepto de “libertad” y de cómo ha visto incrementado su campo de actuación en materia de Derecho de Familia. Además, hablaremos de rupturas matrimoniales y de los acuerdos a los que pueden llegar los cónyuges en momentos previos a dichas rupturas o incluso ya producidas las mismas, haciendo especial referencia en este último punto al convenio regulador y al convenio que no ha sido aprobado judicialmente.

[EN]The fundamental objective of the work is to investigate a little more about the principle of autonomy of the will and the premarital agreements to which the spouses can arrive in anticipation of a rupture of their marriage. We will talk about the limits of this principle, about its relation to the concept of "freedom" and how it has increased its field of action in the area of Family Law. In addition, we will discuss marital disruptions and agreements to which the spouses can arrive in moments prior to these ruptures or even already produced, with special reference in this last point to the regulatory agreement and to the agreement that has not been judicially approved.
