EL CÓNYUGE SUPÉRSTITE EN EL DERECHO COMÚN. ESPECIAL REFERENCIA A LA SUCESIÓN INTESTADA, PECULIARIDADES FORALES Y A LAS PAREJAS DE HECHO.

Abstract

Cada año fallecen en España un alto porcentaje de personas sin testamento. Cuando esto ocurre se producen situaciones desconocidas para los herederos. Más aún para el cónyuge supérstite, quién por las circunstancias que rodean tal hecho, puede encontrarse perdido en todos los trámites jurídicos. El objetivo de este trabajo es solventar las dudas de cualquier persona que se pueda encontrar en esta situación y conocer qué diferencias puede encontrar dependiendo de su lugar de residencia. Así, trata de responder a la pregunta: ¿cuáles son las especialidades que encuentra el cónyuge supérstite tras la muerte de su cónyuge? Del mismo modo, se aborda la figura de las parejas de hecho y la situación de ambos en los países de la Unión Europea. Every year a high percentage of people without a testament die in Spain. When it happens, situations arise that are unknown to the heris. Even more so for the surviving spouse who, because of the circumstances surrounding such event, may find himself or herself lost in all legal issues. The objective of this work is to solve the doubts of any person who may find themselves facing this situation and to know what differences they may find depending on their place of residence. Thus, it tries to answer the next question: what are the specialities that the surviving spouse finds after the death of his or her spouse? In the same way, the figure of unmarried couples and the situation of both in the countires of the European Union is addressed.
