LA PROTECCIÓN E INTERNAMIENTO DEL MENOR CON TRASTORNO DE CONDUCTA EN CENTROS ESPECÍFICOS

Abstract

[ES] Los menores de edad son sujetos vulnerables que necesitan protección, ya que se encuentran en una edad en la que es imprescindible su eficiente desarrollo humano en todos los ámbitos vitales. En los últimos años ha habido un auge de menores con comportamientos disruptivos que no respetan derechos ajenos, normas o reglas sociales; los menores con trastornos de conducta. Esto, unido a las inmensas lagunas estatales en cuanto a dichos sujetos, ha provocado que el legislador amplíe la protección del menor a partir de las Leyes 8/2015 y 26/2015, las cuales han garantizado muchos derechos a estos sujetos, adaptando nuestra antigua ley a la Ley Internacional actual, e introduciendo y regulando un tipo de centro de protección especial destinado a menores con problemas de comportamiento: el internamiento en centros específicos de menores con problemas de conducta.

[EN] Children are vulnerable subjects who need protection, and that is because they are at an age when their efficient human development is essential in all vital areas. In recent years there has been a boom of children with disruptive behaviors that do not respect the rights of others, norms or social rules; children with behavioral disorders. This, fact, united with the immense state gaps regarding these subjects, has caused the legislator to extend the protection of minors from Laws 8/2015 and 26/2015, which have guaranteed many rights to these subjects, adapting our old law to the current International Law, and introducing and regulating a type of special protection center for minors with behavioral problems: placement in specific centers for minors with behavioral problems.
