MALOS TRATOS EN EL ÁMBITO FAMILIAR

Abstract

[ES] El estudio de este dictamen jurídico se centra en el delito de malos tratos en el ámbito familiar, es decir, sobre la esposa y sobre las hijas menores, una propia del autor y otra traída al matrimonio por la esposa. Además de este delito, nuestro caso también presenta el delito de agresiones y abusos sexuales, amenazas y un quebrantamiento de medidas posteriores a la denuncia, todos ellos respecto de las mismas personas y derivados del primero. Este procedimiento se encauza por los trámites del juicio sumario el cual, está integrado por una gran cantidad de diligencias encaminadas a la averiguación de los hechos denunciados, y que por tanto, hemos tenido que estudiar.

[EN] The study of this legal opinion focuses on the crime of mistreatment in the family, that is, on the wife and the minor daughters, one of the author and another brought to the marriage by the wife. In addition to this crime, our case also presents the crime of aggression and sexual abuse, threats and a breach of measures subsequent to the complaint, all of them with respect to the same persons and derived from the first. This procedure is channeled through the proceedings of the summary trial, which is composed of a large number of procedures aimed at ascertaining the facts reported, and therefore, we had to study.
