La calificación del concurso está dirigida al estudio de las conductas y comportamientos que el deudor y los cómplices hayan tenido a lo largo de todo el proceso concursa!. La calificación del concurso dependerá de ese comportamiento, de manera que el concurso se calificará como "culpable" cuando hayan concurrido hechos que hayan provocado ó agravado la situación de insolvencia, perjudicando lo intereses de los acreedores . En cambio, se calificará el concurso como "fortuito", cuando las conductas del deudor no constituyan ningún daño para los intereses de los acreedores.
