Podemos definir la inmunidad como una garantía con fundamento en la independencia y la integridad del Parlamento. Los miembros que gocen de inmunidad no pueden ser objeto de un proceso judicial que derive del ejercicio de sus funciones, no podrán ser, por lo tanto, detenidos ni investigados sin autorización previa. El objetivo de este trabajo es conocer en profundidad el concepto de “Inmunidad” tanto en el territorio español como en la UE, estableciendo su origen y antecedentes, haciendo una comparación y diferenciando el término “Inmunidad” de “inviolabilidad”. Parliamentary immunity is not understood as a personal privilege that is attributed to deputies, both Spanish and European, it is a prerogative that guarantees that the members who enjoy immunity can get to exercise their function or mandate freely, without being object of political persecution. We can define immunity as a guarantee based on the independence and integrity of Parliament. The members who enjoy immunity cannot be the object of a judicial process that derives from the exercise of their functions; therefore, they cannot be detained or investigated without prior authorization.
