La cuestión de la naturaleza jurídica está, en general, circunscrita a la concepción de la provocación ya sea como resolución manifestada, naturaleza esta afirmada por muy pocos autores actualmente, aunque la jurisprudencia en diversas sentencias sigue otorgándole tal naturaleza, ya sea tratada como acto preparatorio, o bien, como tentativa de participación. Así, en el desarrollo del trabajo se plasmarán las argumentaciones propuestas por la doctrina y por la jurisprudencia españolas. Para tratar el tema de la fundamentación de la punición de la provocación se recurre a la exposición de los criterios dados por la doctrina española.The work is oriented to gather the different interpretations on the legal nature offered by the doctrine in relation to the provocation figure typified by article 18 of the Spanish Criminal Code, as well as to highlight the different criteria that support the punishment by the legislator Spanish of it. The question of legal nature is, in general, limited to the conception of provocation either as a manifested resolution, nature is affirmed by very few authors today, although jurisprudence in various sentences continues to grant such nature, whether treated as a preparatory act , or, as an attempt to participate. Thus, the arguments proposed by Spanish doctrine and jurisprudence will be reflected in the development of the work.
