En este dictamen jurídico se plantean una serie de cuestiones jurídicas para resolver mediante la compilación de toda la normativa aplicable y la reiterada jurisprudencia, relativas al derecho a no declarar contra sí mismo, el delito continuado, el efecto de cosa juzgada, la reincidencia, el sobreseimiento de las personas jurídicas en un proceso penal y la condicional de una pena privativa de libertad. Se extraen una conclusiones y para finalizar, se adjuntan aquellos escritos jurídicos que fueron necesarios durante todo el procedimiento judicial, desde la querella criminal y el escrito de acusación hasta el Recurso de Reforma, y subsidiario, de Apelación contra el Auto de Sobreseimiento de las personas jurídicas.[EN] During the development of the present work end of máster will carry out the study of a practical supposition on the crime of elevation of goods, gathered in the article 257 of the Criminal Code.
